1. WARRANTY DISCLAIMER
The SELLER hereby assigns to the BUYER those warranties provided by the manufacturer of the goods being purchased hereunder. The only remedies for a breach of such warranty shall be those remedies specifically provided by the manufacturer of the goods with respect to which such warranty applies. The BUYER hereby agrees to look solely to the manufacturer of the goods for performance, and/or implementation, of the remedies provided by the manufacturer for the breach of such warranties.
THE WARRANTY(S) FROM THE MANUFACTURER IS EXCLUSIVE AND NO OTHER WARRANTY, WHETHER WRITTEN OR ORAL, IS EXPRESSED OR IMPLIED, SELLER SPECIFICALLY DISCLAIMS THE IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR USE.

2. DISCLAIMER OF DAMAGES
The remedies provided herein are BUYER'S sole and exclusive remedies and in no event shall SELLER be liable for direct, indirect, special, incidental, or consequential damages (including loss of profits) whether based on contract, tort, or any other legal theory.

3. USED FURNITURE AND EQUIPMENT
ALL USED FURNITURE AND EQUIPMENT IS SOLD "AS IS" AND WITHOUT ANY WARRANTIES WHATSOEVER. ALL DEPOSITS SHALL BE FORFEITED IF BUYER CHANGES THEIR MIND.

4. CANCELLATIONS
Cancellations or changes cannot be accepted after an order has been put into production, cover has been cut, or the frame has been produced. The order must be shipped upon completion. If there is a delay in shipment, storage charges will apply. Balance due in full upon completion.

5. RETURNS are for credit only less 20% restocking charge.

6. A $20.00 service charge is due on all returned checks.

7. Title to the equipment and material that we have supplied or installed shall remain the property of No. 1 Beauty Salon Furniture, Inc. until paid in full.

8. All balances are due prior to pick-up, delivery, or shipment in cash, cashier's check or credit card.

9, Venue for any litigation between the parties will be in Broward County, Florida. This agreement, and all sales between the parties, will be construed under Florida law, without regard to its conflict of laws rules. The place of sale of all goods is seller’s place of business in Hollywood, Broward County, Florida, even if the place of delivery is elsewhere.

10, Jurisdiction and venue for any litigation between the parties will be in Broward County, Florida. This agreement, and all sales between the parties, will be construed under Florida law, without regard to its conflict of laws rules.

11, If payment is not made when due, or if buyer otherwise violates this agreement, buyer will pay seller a late charge at the rate of 18% per annum on the amount due, plus seller’s reasonable attorneys fees for all matters including but not limited to appeals, and bankruptcy proceedings, plus other costs of collection (including but not limited to costs of enforcing or contesting seller’s security interest in the goods, costs of removing, repairing and reselling the goods, long distance, copies, postage, filing fees, storage, and other expenses).

These are large crates / Cartons.

Commercial trucking lines will deliver your shipment.

The truck driver will deliver your order to the back of the truck.

You will need people to bring these items into your store or home.

Also needed will be a Phillips screwdriver to open these large crates.

Please fully inspect this shipment for any damage before signing the delivery ticket.

Note on the delivery ticket any damage as your shipment is fully insured.

Do not throw away the crate or the packing material if any damage has occurred The claims inspector will want to inspect the damage, the crate and the packing material.

As an option, at an additional charge, you may make arrangements with us for additional service by the delivering truck company. Additional service may include lift gate.
